Got my first ticket today. I was going 61 in a 40 but they wrote me down for only 45. I am thinking of fighting it. They were driving in the opposite direction of me when they clocked me. $75 is not that much to pay but I don't feel like having my insurance go up.

On one hand..they cut you a break. But on the other hand...a ticket for 45 in a 40 won't stand up too well. I say hire a lawyer

1) The cop was nice to give you a break.

2) They CAN clock you while driving the opposite direction.

3) Check to see if 5 over yields any points (I know in PA 15 over is when points start). If there are no points on your record, your insurance will not go up.

Why spend money on a lawyer... pay the $75 if you got no points.

You can always take defensive driving and get it removed from your record.

If you hire a lawyer it'll cost you more than the ticket itself...

well, i don't know how it is w/ other states...

in mass, you first get a court date w/ a the Judge Magistrate. quick hearing. if it doesn't get reduced/taken away then you can schedule a date with the Judge.

the Judge will know that he clocked you at a certain speed but wrote you down for another. its in the officers notes, and those get sent to court.

you should just take the hit. at least thats what i would do..

^^^^^^Ya I am pretty sure its the same way in RI. He didn't check off if he clocked me, used radar, or used laser. Im not sure if it is required that they give that info but hopefully it is.
